To use the Services (browsing, purchases, etc.) you may need to provide email, billing/shipping, and payment data. You declare that such information is correct, up-to-date, and complete and that you have the rights to provide it.

If you create an account, you are responsible for the activities carried out and for protecting your credentials. You may not transfer or assign the account.

SECTION 2 – OUR PRODUCTS

We represent products and services as accurately as possible, but the rendering of colors and appearance may vary depending on the device. We do not guarantee that quality and appearance will meet your expectations or be identical to images and descriptions.

Descriptions and availability may change without notice. We may limit quantities per subject, area, or jurisdiction, or suspend products at any time.

SECTION 3 – ORDERS

Submitting an order constitutes an offer to purchase. GIANLUCA 1 – FZCO may accept or reject the order at its discretion. The order is confirmed only upon our acceptance via confirmation email. Prior to acceptance, we must receive and process payment.

Please check your cart carefully: we may not be able to cancel or modify orders that have already been accepted. In case of rejection, modification, or cancellation, we will contact you using the contact details provided.

You declare that you are purchasing for personal or family use and not for resale or export.

SECTION 4 – PRICING AND BILLING

Prices, discounts, and promotions may vary without notice. The price applied is that at the time of order and appears in the confirmation. Unless otherwise indicated, prices do not include taxes, duties, shipping, handling, or import costs.

Online prices may differ from other channels. Some offers have their own terms that prevail in case of conflict.

You agree to provide and maintain correct data for purchase and payment. You declare that you are authorized to use the payment method and to pay all amounts due, including any taxes and fees.

SECTION 5 – SHIPPING AND DELIVERY

Shipping and delivery times are indicative and not guaranteed; we are not responsible for delays due to carriers, customs, or force majeure.

Upon entrustment to the carrier, title and risk pass to you. For any digital products, delivery occurs via download or access link.

SECTION 6 – INTELLECTUAL PROPERTY

The Services, including trademarks, brands, texts, images, graphics, videos, audio, design, and organization, are the property of GIANLUCA 1 – FZCO or its licensors and are protected by applicable laws.

Use is permitted only for personal and non-commercial purposes. Any reproduction, distribution, or modification without written consent is prohibited.

GIANLUCA 1 – FZCO names, logos, product or service names, designs, and slogans are our trademarks; they may not be used without authorization. “Shopify” is a trademark of Shopify. Other trademarks belong to their respective owners.

SECTION 7 – OPTIONAL TOOLS

You may be given access to third-party tools. Access is provided "as is" and "as available", without warranties. Use is at your own risk and subject to the terms of the respective providers.

New features or tools fall under these Terms.

The Services may contain third-party materials or links. We are not responsible for content, accuracy, products, services, or damages arising from third-party sites.

Always read third-party privacy policies and terms before purchasing. Complaints regarding third-party products or services should be directed to the third parties.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

The store is operated through Shopify, which allows us to provide the Services; however, sales occur directly between you and GIANLUCA 1 – FZCO.

You agree that Shopify is not responsible for any aspect of sales, including injury, damage, or loss arising from purchases. You expressly release Shopify and its affiliates from all claims related to your transactions with us.

SECTION 10 – PRIVACY POLICY

Personal data collected through the Services is processed according to our Privacy Policy: /policies/privacy-policy.

Some data may also be processed according to Shopify's privacy policy. Shopify processes data related to the use of the Services to provide and improve them. Such data may be transferred to countries other than yours.

When you submit ideas, suggestions, or reviews ("Feedback"), you grant us a free, worldwide, transferable, and perpetual license to use, reproduce, modify, publish, and distribute such Feedback for any purpose.

Information on the Services may contain errors, inaccuracies, or omissions, including descriptions, prices, promotions, shipping, and availability.

We reserve the right to correct, modify, or update information and to cancel orders in case of error, at any time and without notice, even after submission.

We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow limitations: in such cases, the mandatory protections provided by law apply.

SECTION 16 – LIMITATION OF LIABILITY

To the maximum extent permitted, GIANLUCA 1 – FZCO, Shopify and their respective affiliates or suppliers are not liable for direct or indirect damages, including loss of profits, revenue, data, replacement costs, and consequential damages, arising from the use of the Services or products.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless GIANLUCA 1 – FZCO, Shopify and their respective affiliates, personnel, and suppliers from claims, damages, liabilities, and expenses, including legal fees, arising from: your violation of the Terms, violation of laws or third-party rights, use of the Services.

SECTION 18 – SEVERABILITY

If any clause is illegal, void, or unenforceable, it will be applied to the maximum extent permitted and deemed severed; the remaining clauses remain valid.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Failure to exercise a right does not constitute a waiver. These Terms and the policies published by us constitute the entire agreement between you and us and supersede any prior agreements or communications, including previous versions of the Terms.

You may not assign, transfer, or delegate this agreement without our written consent. We may assign, transfer, or delegate the Terms and related rights and obligations without notice.

SECTION 21 – GOVERNING LAW

These Terms and any separate agreements whereby we provide you with the Services are governed by and construed in accordance with the laws of the United Arab Emirates.

Exclusive forum: Courts of Dubai (UAE). Both you and GIANLUCA 1 – FZCO accept the competence and jurisdiction of such courts.
